All bookings are subject to the following Booking Terms and the House Rules:

1. CONTRACT & PAYMENTS

The Contract for the letting of 12 Newchurch is between the lead contact on the Booking Form (“You”, “Your”) and the owner of the property (“We”, “Us”).

The Contract comprises these Booking Terms and the House Rules.

For bookings made 60 days or more in advance, this Contract will be entered into and become legally binding once: (a) we receive 50% payment of the holiday price and your completed Booking Form; and (b) we issue a Booking Confirmation to you by email confirming the let dates. The full balance will be payable no later than 60 days before the arrival date. If this balance is not received on time, we reserve the right to cancel the booking and readvertise the dates. Payments made to date will be forfeited.

For bookings made less than 60 days in advance, this Contract will be entered into and become legally binding once: (a) we receive full payment of the holiday price and your completed Booking Form; and (b) we issue a Booking Confirmation to you by email confirming the let dates.

12 Newchurch is let as a Holiday Let as defined in the Housing Act 1988. You may occupy the property only for a holiday on the dates on your Booking Confirmation.

The Contract is governed by English law and jurisdiction, for the hire of the property for holiday purposes only. Bookings cannot be accepted from persons under eighteen years of age.

2. GUESTS

The maximum number of persons able to use the property at any time is six. We reserve the right to terminate the booking without notice and without refund in case of a breach of this condition.

The contract binds you and all members of your party. It is your responsibility to ensure that all members of your party are aware of and accept the terms of the Contract. Failure to disclose all relevant information or comply with these Booking Terms or House Rules may lead to termination of the booking without compensation.

The property shall be used for personal and domestic purposes only for the duration of the rental. The property shall not be used for any commercial purposes. We reserve the right to refuse entry to the entire party if this condition is not observed.

3. DAMAGE & INCIDENTALS

You accept responsibility for any theft, breakage or damage caused by you or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. If there is damage to the property during your stay, or if any cleaning is required beyond normal wear, you may be charged up to an additional £150. The property is inspected on departure. Any queries from us will be addressed in writing to you before a charge is issued.

We reserve the right to refuse further bookings as a result of previous damage.

4. CANCELLATION

You must notify us of any cancellation as soon as possible by email to hello@12newchurch.co.uk.

You can cancel your booking without charge if we receive notice 10 weeks or more prior to your arrival date.

If you notify us of cancellation less than 60 days from your arrival date, all payments you have made will be forfeited.

We strongly advise that you take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.

We will not cancel your booking except due to exceptional circumstances beyond our control. In this event, all payments you have made will be refunded. Our liability for cancellations will be limited to payments you have already made to us.

5. OTHER RIGHTS

We reserve the right to refuse any bookings.

We shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance. Under normal circumstances, we will always ask in advance for permission to enter.

You shall not under any circumstances re-let or sublet the property, even free of charge.

6. LIMITATIONS TO LIABILITY

We accept no liability for any temporary defect or malfunction of any equipment or appliance in the property. No compensation will be given for any temporary outage of electricity, heating, water, internet connection or television service.

We are not responsible for the loss of any personal belongings or valuables, and do not accept liability for injury or loss of life to any person within the premises.

We have taken care to ensure the accuracy of our descriptions. All information is given in good faith and believed to be correct. We may make amendments or improvements between the time you book and your arrival date. Where a change might materially affect the property and your booking, we will communicate this with you as soon as possible.

7. CARE OF PROPERTY

All inventory must remain in the property and not be removed or relocated.

You agree to take all reasonable and proper care of the property and all items in or on the property and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the rental period as at the beginning. You shall abide by all instructions regarding the use of the property and its fixtures and fittings as notified by us.

You shall take care not to leave personal possessions in the property on departure. We will make every effort to return high value items provided that you notify us within 24 hours of departure. We accept no responsibility for personal possessions left in the property following departure. A charge may apply for the return of lost property.

8. UNREASONABLE BEHAVIOUR

We reserve the right to terminate your holiday without compensation where the unreasonable behaviour of you or any member of your party may impair the enjoyment, comfort or health of others.

9. COMPLAINTS

You should immediately report any issues or complaints you may have concerning the property to us and we will endeavour to resolve issues as quickly as possible. Any issues reported after departure are unlikely to be considered.

10. USE OF DATA

In order to process a booking we need to collect and store certain personal data details from you, for example names and addresses of party members, credit/debit card or other payment details.

We would also like to store and use personal details for future marketing purposes, subject to your consent. Only your name and email address will be used for marketing purposes. We will respect the privacy of personal data and will comply with all relevant and current data protection legislation.

11. AMENDMENTS

We reserve the right to make reasonable amendments or additions to our Booking Terms and House Rules from time to time without notice.
